Terms and conditions

General Terms and Conditions of Sale
1. The Terms and Conditions of Sale apply to the rights and obligations arising from the purchase of goods by the customers of the Emamaailm.ee online store (hereinafter the Customer) from Vankart OÜ (hereinafter Emamaailm.ee).
2. In addition to these terms and conditions, the legal relations arising from registration and/or products purchase from the online store Emamaailm.ee are governed by the legislation in force in the Republic of Estonia.
3. The Terms and Conditions of Sale cannot be in conflict with the legal norms in force in the Republic of Estonia, and if necessary (in case of disputes or missing information) they are supplemented with these norms.
4. Emamaailm.ee reserves the right to make changes in the Terms and Conditions of Sale and the selling prices. The said changes will be reflected on the Emamaailm.ee website https://emamaailm.ee/.
5. By accepting the Terms and Conditions of Sale, the Customer confirms that he has read the Terms and Conditions of Sale, agrees with them and fulfills them.
Prices
1. All the prices at the Emamaailm.ee online store are given in euros and include 22% VAT.
2. Emamaailm.ee reserves the right to adjust the prices. If the Customer placed an order before the price adjustment took effect, they will receive the product with the price reflected in the order at the moment the order is placed. The Customer is not entitled to claim compensation for the difference in price.
Finalising the order and paying for the goods
1. When paying for the order, the Customer can choose from the following payment methods -
  1. online: banklink (via Montonio Finance gateway) or regular bank transfer;
  2. in our office in cash or by card;
  3. ESTO or Liisi financial payment service - pay by installments (additional info can be found here);
  4. C.O.D service - pay to courier in cash or by card (available in Estonia only, if corresponding delivery method is selected).
2. Depending on selected payment method, the contract of sale is deemed to be concluded, when -
  1. 100% of the cost of the order has been received to Vankart OÜ bank account;
  2. the confirmation of the successful conclusion of the contract with selected installment partner has been received;
  3. from the moment of receiving the order confirmation, which is the issuance of an invoice or an e-mail with the corresponding content.
Delivery
1. After the contract of sale has entered into force, Emamaailm.ee will complete the order and hand it over to their logistics partners for delivery.
2. The delivery times, indicated on the selected product(s) pages, apply from the moment the contract of sale has entered into force.
3. The accuracy of the contact information presented in the order determines whether delays and misunderstandings arise in the delivery of goods or not. Emamaailm.ee is not responsible for the delays and misunderstandings arising in the delivery of goods if they are caused as a result of the Customer presenting inaccurate contact information in the order
4. Emamaailm.ee will replace the products, but not the product packaging, that have been damaged during delivery. If replacement is not possible, Emamaailm.ee will offer to repair the damaged Products at our expense or return the damaged Product and reimburse the Customer for the amount paid for the damaged products.
Right to return
1. Pursuant to subsection 56 (1) of the Law of Obligations Act, the Customer may withdraw from the contract within 14 days after receiving the goods.
2. Returned goods must be unused, undamaged, and in their original packaging.
3. The Customer must bear the cost of returning, unless the reason for returning is non-compliance with the order or defective goods.
4. To return the goods, the Customer must send a free-form statement to the e-mail address info@emamaailm.ee within 14 days after receiving the goods. The statement of withdrawal must include the name of the Customer, the name of the product, and the invoice or the order number.
5. The money paid for the returned goods will be reimbursed to the customer immediately but no later than within 14 days after receiving the statement of withdrawal. Shipping costs are non-refundable.
6. Emamaailm.ee has the right to refuse refunds until Emamaailm.ee has received the products being returned or until the Customer has provided proof to Emamaailm.ee, that he has returned the Product, whichever occurs first.
Liability and claims procedure
1. Emamaailm.ee is liable to the Customer and the Customer is liable to Emamaailm.ee for damages caused to the other party by violating these Terms and Conditions of Sale in cases and to the extent specified in the valid legislation of the Republic of Estonia.
2. Pursuant to the Law of Obligations Act, the Customer is entitled to make claims against the seller in case any lack of conformity of a product becomes apparent within two years as of the date of delivery of the product. It is presumed that any defect that becomes apparent within the first six months existed at the moment of the sale and, therefore, the nature of the defect is to be identified by the seller.
3. If a product defect occurs, the Customer must inform Emamaailm.ee thereof by sending them an e-mail to info@emamaailm.ee and include the following: their name, contact information, and a description of the product defect. If it is possible, please add photos / video describing the defect. The statement must be sent no later than two months after discovering the defect.
4. Emamaailm.ee is not responsible for:
  1. Damages caused to the product by the fault or negligence of the Customer;
  2. Defects caused by the misuse of the product by the Customer;
  3. Natural wear and tear of the product.
5. The Customer has the right to apply to the competent supervisory authority, which is the State Consumer Protection Board at Pronksi 12, 10117 Tallinn, e-mail: info@tarbijakaitseamet.ee
6. If the Customer and Emamaailm.ee are unable to resolve the dispute amicably, the Customer may refer the matter to the Consumer Disputes Committee, more information can be found here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the Customer and the online store. The review of the Customer's complaint in the commission is free of charge.
7. The Customer also has the right to apply to the European Online Dispute Resolution (ODR) platform.
Privacy, security and data processing
1. By using the Emamaailm.ee website, the Customer gives explicit and informed consent to the processing of their personal data by Emamaailm.ee.
2. Emamaailm.ee uses the information provided by the Customer only to execute purchase orders and does not disclose them to third parties, except in case it is required by law.
3. An encrypted data channel with banks ensures the security of the purchaser's personal data and bank details and Emamaailm.ee does not have access to them.
4. What personal data are processed:
  1. name;
  2. contact information such as a telephone number and an e-mail address;
  3. payer’s address and delivery address;
  4. bank account number;
  5. costs of goods and services and data related to payments (purchase history);
  6. customer support details.

Force majeure
1. Emamaailm.ee is not liable to the Customer for the caused damages or the delay of the delivery of the product if the damages or the delay of the delivery of the product are caused by events that could not have been avoided or foreseen by Emamaailm.ee.
Other terms and conditions
1. Product images are for illustrative purposes only.
2. Product information is checked and improved regularly. The data may have been updated since the last visit of the Customer.
